1) Website Operator & Domain

This website (us.egmcigars.com) is operated by Chaveta North America Inc (“EGM Cigars”, “we”, “us”, “our”). We are the registrant/operator of this domain.

2) Agreement & Acceptance

By accessing or purchasing from us.egmcigars.com you (“you”, “customer”, “cardholder”) agree to these Terms & Conditions (“Terms”). The latest version is published on this page and supersedes prior versions. You must actively accept these Terms at checkout (checkbox) before placing an order.

3) Age Restriction (U.S. 21+)

We do not market or sell tobacco products to persons under 21 years of age (or higher minimum age where applicable). By using the site or placing an order, you confirm you are of legal age and consent to age verification via third-party databases. Use by underage persons is prohibited.

4) Health Warning

Cigar smoking is hazardous to health. Smoking causes lung cancer, heart disease, and other serious conditions. EGM Cigars bears no liability for adverse health effects arising from tobacco use.

5) Products, Pricing & Taxes

Product pages include descriptions, images (where applicable), and prices in USD, inclusive of applicable U.S. sales tax where required.
We do not sell Cuban cigars. Our focus is EGM Cigars and accessories.
Images and packaging may vary slightly from batch to batch; typographical errors may occur.

6) Orders, Acceptance & Availability

Your order is an offer to purchase. We may accept or reject any order at our discretion (e.g., availability, verification results, compliance checks). Order confirmation and a receipt are emailed upon completion of payment.

7) Payments & Bank Statement Descriptor

Payment timing: Your card is charged at the time of order.
Methods accepted: Visa, Mastercard, American Express.
Descriptor: Charges typically appear as “EGM CIGARS” or “EGM CIGARS – us.egmcigars.com”. If you do not recognize a charge, contact us before opening a dispute.
You confirm card details are accurate and authorize us (and our processor) to charge the total amount including shipping and taxes.

8) Shipping Options & Delivery Times

Dispatch: Usually within 2–4 business days after order confirmation.
Domestic U.S. transit: Approx. 2–7 business days after dispatch (non-binding; carrier/locale dependent).
Tracking: All parcels include tracking; you will receive a tracking email when shipped.

9) Cancellation Policy

You may cancel within 24 hours of purchase by emailing info@egmcigars.com. Requests via social media/chat are not accepted.
If the order is already fulfilled or the 24-hour window has passed, the shipment may be recalled/returned where possible; upon safe return, a 23% restocking fee applies.

10) Returns, Refunds & Complaints (RMA Required)

Return window: Contact us within 5 days of delivery for return authorization (RMA). Returns without RMA may be refused.
Condition: For cigars, original bands/tubes/cellophane must remain intact. Taste preference alone is not a defect.
Return address: EGM Cigars — Returns Center, 3379 Day Ave, Miami, FL 33133, USA. Include your RMA number and ship with trackable service.
Outcome: Upon inspection, we will replace, credit, or refund. If products are returned in good condition after a failed delivery not caused by you, a 21% administrative fee may apply.
Complaints: Email info@egmcigars.com (order number, description, photos). We acknowledge within 1 business day and aim to resolve within 5 business days.

11) Legal Warranty & Consumer Rights

We warrant that goods will conform to description and be free from manufacturing defects at delivery. Remedies are limited to repair, replacement, store credit, or refund as set out above and subject to inspection. Your statutory rights, where applicable, remain unaffected.

12) Customs & Compliance

For any non-U.S. deliveries, you are responsible for ensuring import compliance and for any duties/taxes/fees assessed by local authorities. We are not liable for seizure, delays, or refusals by customs/regulators. We do not sell Cuban cigars.

13) Checkout Transparency

Country displayed: The merchant country (United States) is shown at checkout.
Card logos: Up-to-date Visa, Mastercard, and American Express logos are displayed where applicable.
Acceptance: By completing payment, you confirm you have read and accepted these Terms & Conditions.
Receipts: A receipt is emailed after successful payment.

14) Privacy & Data Protection

Our Privacy Policy explains what data we collect, how we use/store it, and your rights. We use SSL/TLS encryption site-wide and follow appropriate technical and organizational measures to protect personal data. Do not submit information if you do not agree with our Privacy Policy.

15) Security & SSL

The website uses SSL encryption to protect data in transit. Do not proceed with checkout if your browser indicates an invalid or insecure connection.

16) Recurring Transactions / Series

Subscriptions or recurring card payments are not currently offered. If introduced, we will comply with applicable card-scheme rules (including Mastercard/Visa requirements) and provide clear disclosures and cancellation options.

17) Intellectual Property

All site content (text, images, code, trademarks) is owned by or licensed to us and protected by applicable laws. No content may be reproduced or used without prior written permission.

18) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, lost profits, or losses arising from use of the site, delays, carrier/customs actions, or events beyond our control.

19) Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in the state or federal courts of Miami-Dade County, Florida, and you consent to their jurisdiction.
